Q: Update: Blu's response to FDA's Marketing Denial Order

We are disappointed with the FDA’s decision and disagree with the scientific evaluation and conclusions they reached. We believe our products meet the regulatory requirements and plan to use the administrative appeals process to convince the agency that approval should be granted. Based on past practice, we expect the FDA will not seek to enforce the MDOs while this appeal remains ongoing, and we therefore expect the products to remain in the market during this period.

Q: Why can’t my order ship to NY State?

***Due to recent legislation, we will no longer be shipping flavored vapor products to NY State as of May 17, 2020. This applies to all flavors, including Menthol. Tobacco flavors will continue to be available until July 1, 2020. *** ***We will also no longer be shipping any blu products to addresses in NY State after July 1, 2020. ***

Q: Why can’t my order ship to Vermont?

The State of Vermont does not allow us to ship vapor products into their state.

Q: Why can’t my order ship to Maine?

The State of Maine does not allow us to ship vapor products to consumers in their state.

Q: Why can’t I order flavored products in Massachusetts?

Massachusetts does not allow us to ship flavored vapor products into their state. Tobacco flavors will continue to be available.

Q: Why can’t I order flavored products in Rhode Island?

Due to recent legislation, we will no longer be shipping flavored vapor products to Rhode Island. This applies to all flavors, including Menthol. Tobacco flavors will continue to be available.

Q: What happens to my Autoship order?

If you had an Autoship order containing one of the restricted myblu flavors, we had to cancel that standing order. The last Autoship orders with these products was sent on January 30th, 2020. We invite you to please visit our Autoship page to create a new Autoship order with our many available products.

Q: Why are we removing these flavors?

Due to new flavor restrictions, we will not be processing certain myblu podpack flavors and blu PLUS tanks from blu.com. We hope to bring these flavors back soon!

Q: Will these flavors be available again?

As of this time, the restricted myblu and PLUS tank flavors will not be returning for sale on blu.com.

Q: Will there be tax implications? Will e-cigs be taxed like regular cigarettes everywhere?

FDA do not address taxation of electronic cigarettes. Although, there are some vapor taxes already in place at the state level. To know your local vapor laws go to your state or local law source for more information.
